THE NOTION OF CRIMINALISTIC SITUATIONS AND THEIR INFLUENCE ON CRIMINAL CASES CONSIDERATION

On the basis of special literature and judicial practice, the essence of some judicial
situations, that may occur during the criminal cases examination and consideration in the
trial court has been analysed. Their notion, correlation with the investigatory and criminalistic
situations are presented, their influence on completeness and all-sidedness of such an
examination is shown. The main attention is paid to the factors that form these situations
and the criminalistic means of their timely taking into account by the court, public prosecutor
and defence-counsel.
