MOTIVE OF THE COMMITTED CRIME AS FACTOR THAT INFLUENCES THE CONVICT’S ATTITUDE TOWARDS THE SENTENCE, PUNISHMENT AND ITS SERVING

The degree of judicial scrutiny of motives of crime’s commission and reasons for their
appearance, influence of the court’s evaluation on the convict’s attitude towards the
sentence, punishment and its serving have been elucidated. Motives envisaged in the norms
of the Special Part of the Criminal Code of Ukraine influence on the crime qualification and
determine the intentional actions of a person. They define the gravity of a crime and
characterize a person that committed a crime. They are one of the determining signs while
setting a punishment and may be taken into account as aggravating or extenuating
circumstances. The account of reasons for the crime committed has been analyzed while
conducting individual work with the convicted by the author.
