FORMATION AND EVOLUTION OF THE INSTITUTION OF INSOLVENCY AND BANKRUPTCY IN SOME FOREIGN COUNTRIES

The formation and evolution of the insolvency institution or the relations connected with
the failure to pay the debts in some foreign countries are investigated. The punitive
measures for the debtor were typical at the initial stage of its evolution. Later, the
differentiation of the personal and property liability began, it depended on the presence of
guilt in the debtor’s actions.
