THE CONCEPT AND SUBSTANTIVE CONTENT OF CRIME VICTIM’S HELPLESS STATE IN CRIMINAL PROCEEDINGS OF UKRAINE

The main criteria of the substantive content of crime victim’s helpless state are under
consideration. While analysing them, the author uses judicial practice. On the basis of these
criteria, substantive concept of the crime victim’s helpless state at the moment of the crime
commission is formulated. Its legal meaning in the proceedings is studied.
Key words: victim’s helpless state, legal and medical criteria, physical and mental
defects.
