COURT PRACTICE IN THE MECHANISM OF CRIMINAL-PROCEDURAL REGULATION AND FORMS OF ITS EXPRESSION

Legal category "court practice", forms of its external expression, as well as its role in the
mechanism of legal regulation, of criminal-procedural regulation in particular, have been
studied. The author substantiates the conclusion that under new legal realities in Ukraine, court
practice in its two superior forms – leading and precedential, – in which judicial creativity is
clearly manifested, is one of the sources of law in general, and of criminal – procedural law, in
particular.
